TERMS AND CONDITIONS
1.Best Price Guarantee. Subject to the requirements set forth herein, in the event that you find a lower rate for one of our Hotels (as defined below) within 24 hours of booking on morganshotelgroup.com and at least 24 hours before your booked check-in date, Morgans Hotel Group (“Morgans,” “we” or “us”) will match the rate and give you an additional ten percent (10%) off the matched room rate. Notwithstanding the foregoing, in order for the competing rate to be valid: (1) you must have an existing reservation booked through morganshotelgroup.com and (2) there must be a currently available lower published rate on another website for the same Hotel with an exact itinerary match (as further specified in Section 5 below). The comparison rate quoted must include all applicable Booking fees, extra adult fees, fees for children, and rollaway charges. Taxes, gratuities, or any mandatory charges that may apply will be excluded from the rate comparison. This Best Price Guarantee is subject to all of the provisions of these Terms and Conditions (the “Terms”). As used herein, “Hotels” shall mean: all hotels that are listed and can be booked through morganshotelgroup.com.
2.Notifying Morgans of a Claim. In order to make a claim under our Best Price Guarantee program, you must submit a request through the Best Price Guarantee Form within 24 hours after making your booking on morganshotelgroup.com and at least 24 hours before your check-in date. The Best Price Guarantee Form is located at www.morganshotelgroup.com/page/best-price-form. The lower rate must be available for booking at the time you contact us, as determined by our customer service representatives in their sole discretion. The name on the Best Price Guarantee Form must match the name on the confirmed reservation for each room. Only one Best Price Guarantee claim may be submitted for each confirmed reservation.
3.Determination of Claims. Morgans shall have the sole right and discretion to determine the validity of any claim. Morgans will verify the competing rate within 1 business day of receiving your claim and notify you of the results. Morgans will not review documentation provided by the individual submitting the claim as a part of its validation process, including without limitation screenshots or other purported evidence of a lower price, nor will it verify any request that it believes, in its sole discretion, is the result of a printing or other error or is made fraudulently or in bad faith. Claims that are incomplete or incorrect, or that include illegible or incomplete supporting documents will not be processed. Without limiting the foregoing, if the availability of a competing rate cannot be independently verified, Morgans reserves the right to deny such competing rate at the time it processes the claim, and to deny such claim in its discretion. Furthermore, you acknowledge and agree that rejection of a claim is valid if the rate disparity is due to currency exchanges, meaning that there needs to be a difference greater than two percent (2%) of the total room rate in order to protect against this discrepancy. Morgans may deny claims if it believes that Best Price Guarantee is being intentionally abused or manipulated to circumvent its intent. Without limiting anything contained herein, Morgans may, at any time and without notice, terminate or restrict your ability to submit a claim under or otherwise benefit from the Best Price Guarantee program if, in its sole discretion, it determines that you have acted in a manner inconsistent with applicable laws or ordinances, acted in a fraudulent or abusive manner, submitted multiple invalid Best Price Guarantee claims, failed to stay at a one of its Hotels after receiving approved Best Price Guarantee claims, or breached any Best Price Guarantee terms.
4.If Morgans Verifies Your Claim. Any properly approved and verified requests will receive the adjusted room rate at the time of check out. For rooms that are pre-paid, Morgans will ensure you receive the adjusted rate at the time of check out by issuing a refund for the difference or by providing a complete refund and then recharge at the reduced rate.
5.No Change to Booking. Travel must be completed in accordance with the booked itinerary in order to be eligible to receive the matched rate and discount. Changed or cancelled bookings are not eligible to receive these benefits.
6.Must be “Apples to Apples” Comparison. The Best Price Guarantee is available only for exact itinerary matches. For example, the rate must be for the same Hotel, the same dates, the same number of guests, the same room type (with the same view and room size), and include the same or additional value-added amenities. The Best Price Guarantee is available only when the guarantee and cancellation policy are comparable. For clarity, rate comparisons offered on only a portion of your booked stay will not be valid. Furthermore, the Best Price Guarantee is not available for bookings on websites where the hotel booking details are unknown until after purchase. You must meet all requirements imposed on the lower price (if any), including, without limitation, residency, regional and age-related requirements. For claims concerning a booking of two or more consecutive nights (at the same hotel), the Best Price Guarantee applies on the basis of the price per night and not on the total amount of the stay.
7.Comparison Rates Must be Available to the General Public Online. The Best Price Guarantee applies only to prices both advertised and available to the general public on an English-language website. For example and without limitation, this does not include the following:
8.Program Subject to Changes and Discontinuance. Morgans reserves the right, in its sole discretion, to modify or discontinue the Best Price Guarantee program or to restrict its availability to any person, at any time, for any or no reason, and without prior notice or liability to you. The terms that are in effect at the time of your booking will determine your eligibility under the Best Price Guarantee program.
9.Limitations; Qualifications. This Best Price Guarantee discount is not redeemable for cash and has no cash value. The Best Price Guarantee discount is not transferable to other guests or to other bookings, and it may not be combined with or applied to any other coupons, promotions, special offers, or bookings. All taxes, fees, charges, and surcharges applicable to the booking, including, without limitation, extra person, phone, parking, and other charges are applicable to your reservation, and the Best Price Guarantee discount cannot be applied to them. These charges must be paid at the time the room charges are paid and are solely your responsibility. Furthermore, the Best Price Guarantee discount cannot be applied to the cost of cancellation or change penalties, prepaid reservations, administrative fees, or other miscellaneous charges, which are solely your responsibility. The Best Price Guarantee discount will be deemed to have expired after the applicable booking date has expired and will not be replaced, even in the event that the reservation is cancelled.
10.Change your Mind.Should you wish to cancel the reservation made on morganshotelgroup.com, the sales and conditions applicable are those stated in the sales condition presented on the website. Cancellation charges apply if a reservation is changed or cancelled after the deadline identified in the rate rules.For certain rates and rooms (for example, advance purchase rates), changes to the reservation may not be permitted once booked.Applicable restrictions are communicated in the rate rules for each reservation.
